 We, the following past presidents, past officers and ANA life members  have decided not to attend the proposed meeting in Chantilly, Virginia during the July 4th weekend.  This meeting has been dubbed as ANA Convention 2011, but we do not believe it is a genuine ANA convention, as it is not supported by many life members and past officers. The meeting organizers have also not contacted the newly elected officers of the ANA for the term 2011-2013.

ANA Affairs Press Release

After the 2011 election result announcement, conflicting reports, debate and confusion seem spreading.  Here I have tried to put some conclusions based on the facts so that Nepali communities can make informed observations and their own conclusion.  Let us try to follow the rules, work together, and help Nepali cause without tarnishing Nepali name and reputation.

Decisions of June 15, 2011 Meeting Invalid:

The Special Emergency Meeting of the ANA Executive Board held June 15, 2011 was not a valid ANA meeting, and  decisions made at that meeting (see below) were not valid ANA decisions since almost all of the so called board members attending the meeting were not valid paid ANA members;  non-paid members do not have voting rights  according to ANA bylaws.  According to the ANA website, as of June 21, 2011, there are 19 members on the ANA Executive Board.  They are:

I checked the names of the Executive Members and officers against the membership list published by the Membership Verification Committee.  President Simon Dhungana is the only ANA member in the so called ANA Board.  Even the Secretary and the Information Director were not valid ANA members. Other persons attending the meeting at the best can be considered honorary members at the pleasure of the executive officers.  According to ANA bylaws, “Honorary Members do not have to pay any membership dues, and are not allowed to vote in the affairs of the Association.”   Currently 3 persons are serving as executive officers; two of them are not even members of ANA with voting rights as mentioned above.  Same thing applies to Mr. Basant Shrestha, the chair of the Membership Verification Committee (MVC) and the three members of the ANA election committee (Sudeep Shretha, Sharda Khati and  Hira Sharma).  Since they are not paid ANA members, they cannot vote on ANA affairs; they can only assist and advise the committees.  Again, only the paid members can vote to make decision on ANA affairs.   Giving the ANA board membership to persons who have not paid membership due is not only against the ANA bylaws, it may also be considered wrong for other reasons.  When the meeting is run by one valid member of the ANA board, and in which decisions are made by non-ANA members, how in the world you can consider it an ANA meeting.  Therefore from ANA points of view, the decisions and the meeting of June 15 do not belong to ANA and are invalid.

An Experience of June 15, 2011 Meeting:

I am an ANA life member and the Information Director elect.  I attended the so called June 15 emergency meeting of ANA.  When I asked at the meeting the number of board members, no one had an answer for this. When I asked at the meeting if there was a quorum for the meeting, I was shouted at by a non ANA member not to raise a question of quorum when such a big crisis was happening in ANA.  There was no roll call, no motion moved and no second of any motion.  At the end, Mr. Sherpalama informed about the decisions made at the meeting; he could really have said any thing he wanted; Mr. Sherpalama is not even listed as an executive board member  No parliamentary rules were followed for these decisions.  Even though we disagree, the meeting should have been conducted following democratic parliamentarian rule.

President Dhungana’s Conduct:

Current ANA administration especially the president has failed to fulfill its responsibility in a number of ways defaming the organization and creating all kinds of problems and crisis such as the Boston convention mismanagement,  installing ineligible persons in the ANA board, not updating membership list,  not keeping financial books  in an orderly manner (example of the Boston convention is the obvious one) and going against the advice of almost all past presidents and life members.     There was an unpaid bill of about $85,000 in which about $50,000 was for the hotel bill.  Life members of ANA came to the rescue to save the reputation of ANA donating money to settle the hotel bill.  Consequently, he was asked to resign by past presidents and life members.  But he declined to do so, and some members argued to give him an honorable exit provided he cooperated to hold election in an agreeable manner.  As a result, a general body (GB) meeting of ANA was held and election was conducted.  Rather accepting the result of the election gracefully, he went against it with the support of non ANA members.   In this scenario, the DC meeting arranged by him and mostly non ANA members is not endorsed by the elected officers of ANA, almost all past ANA presidents and virtually all  ANA life members, and we elected body declare that ANA will not be responsible if any liabilities is caused by the meeting.

Membership and Disqualified Candidates:

Apparently annual ANA registrants were told that they would have one year membership.  But this membership clause was never amended in the ANA bylaws.  Without amending it within 60 days, it does not become effective according to ANA bylaws.  From this point of view and other reasons as pointed by MVC, the membership of the Boston convention registrants becomes null and void to vote in 2011 election.  Since the 2011 election was uncontested as there was only one qualified member for each position, the membership issue was a moot matter from the election purpose.  The MVC published the eligible voters list by giving an opportunity to eligible voters not listed to approach the MCV with proofs of the membership.  Why the disqualified candidates on the basis of the membership list did not even try to approach the MVC proving that they were ANA members.  Now they try to cry foul after the announcement of the election results.

Membership Verification Committee (MVC):

The MVC did a great job by following ANA bylaws.  We understand its published report was signed by 3 members out of 4 members of the Committee.   Two of the members changed their position calling the report flawed after the election result was announced.  By the way these 2 members are not even paid members of ANA and do not have voting right according to ANA bylaws.  The other 2 members who have voting rights have not changed their position.  So the MVC report stands as is and cannot be called flawed especially after the announcement of the election result.  You just cannot play the same game again after the game is over.

Election Committee:

The Election Committee chair who is a life member of ANA also performed an outstanding job by following ANA bylaws and good judgment under the situation to conduct a fair and free election within the stipulated time.  The Committee consisted of 4 members.  Mr. Raja Upadhyay was the chair of the Committee who was given the mandate of conducting the election by the ANA general body (GB); Mr. Sherpalama or the President Dhungana or anyone else has nothing to do with the election after the mandate.   President Dhungana provided 4 persons (Sudeep Shrestha, Sharda Khati, Hira Sharma and Ramakant Adhikari) to assist Mr. Upadhyay to conduct the election.  Ramakant Adhikari did not serve the Committee. The  3 people that served were not ANA paid members and therefore, did not have voting rights.  As a matter of fact, Dr. Sudeep Shrestha who was referred wrongfully as Co-Chair or Vice-Chair had disqualified himself to be a member of the Committee.  Since these three people did not have any voting rights, they did not have any decision making power.  They were in the Committee simply to assist Mr Upadhyay in clerical works.  Mr. Upadhyay was given the sole authority by the GB to conduct the election.  Of course they were working for Mr. Dhungana/Mr. Sherpalama, and started making statements against Mr. Upadhyay when the election result did not favor their candidates.  These 3 people have no power or right to go against the decision of Mr. Upadhyay.

Rights of Non-ANA members:                     

The works and conclusions of the Membership Verification Committee  and the Election Committee is according to the ANA bylaws and the general body meeting of genuine ANA members supported by past ANA  presidents and ANA members.  If non-ANA members do not like it, they have no legal ground/right to challenge it going against the decisions of these committees.

Dear Members and Well Wishers of ANA,

Mr. Raja Upadhyay, who has conducted each and every Election for ANA since about late 1980′s or early 1990′s was unanimously nominated by the Special General Body Meeting of May 01, 2011 to be the Chief Election Commissioner with independent powers vested in him, as per the past tradition of ANA. He was provided with three other individuals to assist him in conducting the Election. These other individuals were not given independent powers. They were to help the Chief Election Commissioner whenever asked for, on as needed basis.

Mr. Raja Upadhyay and the team had duly announced the election process outlining the modus oparandi of nomination, sending out and counting the ballots. A PO Box was rented near the site of ANA Convention in Virginia. However, since
the nominated list of candidates for the five Officers’ position had no eligible contestants in competition, except one person for each of the five positions, the chair did not need the help of the other individuals in his team. The election chair, therefore proceeded, rightfully, as he had done in the past, to declare the uncontested individuals elected by acclaim. We heartily thank the Chair of the Election Commission and the individuals members of the team supporting the chair.

All the Elected Officers are veteran ANA members with a long history of community service and deserve our congratulations, good wishes and cooperation in the task ahead of uniting ANA. We have known each of them personally for decades and can vouch for their integrity of character, good judgment and devotion to work for the betterment of Nepalis in the Americas in general and now for ANA, in particular. They cover North-East, Pacific-West, Central Canada, Atlantic South-East, and West Virginia, a true cross section, as it happens, of our North American continent.

We also wish to state that the Membership Verification Committee did an outstanding job. Each and every one of them deserves our praise and deep gratitude for the hard work done without compensation.

President elect Mr. KC and his team have advised us that they will work to accommodate other interested individuals in the ANA officers or executive team after the ANA convention in Washington DC, and after following a due process.

Special Emergency Meeting of the Executive Board of ANA

 Membership Verification Committee with majority decision  has withdrawn the MVC report submitted to Executive Board since it was flawed and declared it void since new information have come to light. It was mistakenly released to public.

Election Committee with all four member’s decision has put on hold election schedule until further notice. ITFANA has issued a notice on that as well. Election Committee has asked for clarification from Election Committee Chairman who is out of country and went against the decision of the committee without informing them.

        As previously discussed a transfer of deeds from ANA to NECC was to be decided.

        In light of this a Special Emergency Meeting of the executive board was held. The meeting was called according to the bylaws regarding meetings and decisions were based according to concerning articles of the bylaws. All options were considered proposed by concerned committees and decisions were reached unanimously on all.

Decisions:

The decisions of the meeting will be submitted to Annual General Meeting (AGM) of ANA for approval/ disapproval.  The decision of AGM will be final.

A.  ANA Election 2011 postponed by one month
B. All convention registrants become automatic members upholding previous executive board decisions,  practices, traditions that are according to the bylaws of the association.
C. New/ renew membership application would be allowed for two weeks after convention.
D. Election would be held in two weeks after the membership closes.
E. Election candidates’ interaction/ debates to be held during the convention.
F. The current executive board’s term will end on July 4^th at the conclusion of the convention as previously scheduled.  The current Executive Board will handover to caretaker executive committee on July 4th. Caretaker committee will be in place until the election results. 
G. Implementing Annual General Meeting decision of 28th ANA Convention, ANA will also be known as Federation of Associations of Nepalis in America forthwith.
H. Previously formed bylaws taskforce would recommend changes at the 29th AGM.
I. Titles and Deeds of ANA property in Lanham to be transferred to NECC. ANA will share physical address in perpetuity with NECC as brainchild of ANA.
J. The meeting decision will be submitted to Annual General Meeting for approval/ disapproval. The decision of Annual General Meeting of ANA will be final. Office of Secretary of State of Maryland has been contacted regarding the procedure.

        All committees of ANA listed above requests all concerned to ignore any inauthentic emails or opinions or statements of anyone including past presidents of ANA whose role is to advise only.

Reaction to the Recent News on ANA

ANA is in the most critical juncture in its 28 year history.  ANA, one of the first, and the largest among the Nepali associations in North America, was founded by a few forward looking and visionary leaders in 1983. During the past three decades, it has served the community well, and the older generation of leaders and their successors have given much to the organization and the Diaspora, and they should be valued and recognized accordingly.

The current crises in ANA began with the staggering loss of about $87,000 incurred in the 2010 ANA Convention in Boston. Subsequently, through the generosity of some dedicated founding members and other leaders, part of the loss has been made up and the most pressing payment to the venue hotel has been made. The financial fiasco remains to be resolved, and the difficult pages in the ANA books need to be rapidly closed.

This predicament has been compounded by the recent controversy on the election, the results of which were announced just a few days ago. In my knowledge, the election has been conducted genuinely, including in the process only the paid members, who have been verified by an independent membership verification committee (MVC). Both the Election Commission Chair and the MVC were appointed by the General Body of ANA, the seat of the sovereign and ultimate power of the organization.

As seen recently in the media, there seems to be disagreement on this election in some quarters of the ANA well wishers.  I think all should respect the due process, especially at the time of such an unprecedented crisis in the organization.  The organization comes first, and if the organization itself collapses, there will be no positions for anyone.  In talking to the newly elected leaders, I have been unambiguously assured that there will be room for all the interested individuals to serve in ANA in leadership positions, as soon as the process of expanding the officer positions is completed by amending the current by-laws. Generally, it is hard to find interested individuals to serve in the non-profits, as there is no compensation.  It is a good sign for ANA and the testament to the founding leaders that many individuals are interested. The will be room in the revitalized for all of them.

Similarly, associations crave for membership.  There seems to be interest among many individuals to become the member of ANA, which is again such a fortunate situation. They should all be welcomed after the organization gets back on its feet in a month or so.  The membership process should be made clear, such as, they would be members should fill a membership form, pay the dues and take a receipt. I do not subscribe the idea that individuals attending a conference automatically become members of an membership-based association.  There should be explicit membership request, payment of dues, and receipt and record process to establish membership.

ANA has many difficulties at present. Even its legal status seems to be in jeopardy. It image has been badly tarnished. The finances are a mess. Members and well wishers have become utterly confused. Given this situation, in my opinion, it will be best for the current leadership to cooperate heartily with the newly elected leaders, and make the transition process smooth.  This will provide an honorable exit for the current set of officers, and will help the organization gradually reestablish its old glory. ANA then would be able to serve the North American Nepali community well for many years to come.

ANA Election 2011 Update

Dear All,

As you all know, the ANA Election Commission was formed by a mandate from the ANA General Body. Likewise, a Membership Verification Team was constituted on the same day by the General Body. The Membership Verification Team provided a report of its findings and a list of valid members on June 8, 2011. Subsequently, the Election Commission came up with the following deadline for filing of nominations:

•  Nomination Filing Deadline: Friday, June 10, 2011
• First of list of eligible voters and nominees to be published, Sunday, June 12, 2011
• Final list of eligible voters and nominees to be published, Tuesday June 14, 2011
• Ballots to be mailed, Thursday, June 16, 2011
• Ballots to be received by Friday, July 1, 2011
• Vote counted on July 4, 2011 at the ANA Convention Site

In order to conduct a free and fair election, the Election Commission rented a UPS mailbox, close to the upcoming convention site in Chantilly, VA. The ballots were to be opened at the convention site on July 4^th.

The election committee was delayed in publishing the list of the candidates by one day because of the weekend and also due to the confusion related to the membership list. It seemed like a few paid members’ names were missing from the list which the ANA Executive Board would provide to the election committee after consulting with the membership verification committee. However, to date no updates have been provided. Therefore, I Raja Prasad Upadhyay, as the Chair of the Election Committee, consider the membership list published by the ANA Membership Verification Committee to be a full and final list. Accordingly, verification has been done against this list.

The election commission has received nominations for the post of the following positions within the stipulated time frame:

Other candidates were disqualified because their names were not in the membership list provided by the Membership Verification Committee. As per by-laws of ANA, to be nominated for a position a person must be a member of the association for at least a year and must be an executive board member for at least one year.

Since, only one valid candidacy could be verified for each position, as the chairman of the ANA Election Commission, I declare those candidates as elected officers for the term July 2011 – June 2013.

I would like to thank the ANA Members and the Executive Board for giving me the opportunity to serve as the Election Committee Chair. It was a privilege to work for ANA and bring this issue to closure. A postponement of election is neither desirable nor necessary or tolerable to me, as I was charged with the job of conducting the election. It is in keeping with ANA tradition for the last 28 years.

The ANA is not just a beautiful body of officers and executives who ask you to congregate once a year for summer vacation in one of the beautiful cities in America. The ANA, perhaps North America’s oldest organization, should be a hope and aspiration for over   two hundred thousand people of Nepalese origin in our new home.  Decades of mismanagement and neglect, however, have led to the endangerment of the hope of future generations of Nepalese origin in North America. If we want this organization around for our children and grandchildren, we have an option today to protect it by making its election process transparent and democratic with a sense of collaborative competition. Wavering in third party thoughts, crinkling grin, and a dark look at each other make dividing line more distinct.

I am sorry; I am caught up in a whirling vortex of emotion with a subaltern sense with few rigged e-mails and non- whiney sound in my inbox. I am wondering why few people are scared to take a long view with remaining glimmer of possibility. The ANA election episode reminded all of us about Plato's "Allegory of the Cave.” The theme of the allegory is that anyone who is in a dark cave for a long time, his/her eyes get perplexed in outside lights and want to move backward. Unfortunately, illumination and forward movement is always better than darkness regardless. Therefore, the dream of a magical ANA election might polarize few of you. However, this misguidance, hallucination, and dark cave is not a better course of action for ANA. Thus, you cannot polarize the rest of hundred thousand people in diaspora and make our community look more depressed and helpless.

     A good many honest people have been disregarding calumny truth that so called blue blooded attempt to vow to establish to somebody superior superficially. Needless to remind you all, but I will that the duck keeps paddling relentlessly underneath but appears smooth and calm on the top. With plethora of immaturity, unfortunately, some of us have been engaged   in wrapting process of   fulminating our community in the worst possible ways. All of you know that a break way separation with break neck speed does not do any good to our community. Many moons ago, as a guest speaker in a principals' convention in Louisiana, the former State Secretary Collin Powell directed all convention attendee, "Principals, never do the blunder by cutting budget on English as a Second Language. Please treat every child in equal eyes. Then equality prevails in America".  Unfortunately, few of you are satisfied with bad passage of mind, discriminating paid ANA members, your own Nepali brothers and sisters. Anyway, people won't believe on such specious arguments. Moreover, I want to highlight few basic leadership quality that my Hopkins’s professor shared with us, “A good leader challenges the process, share his/her vision, enable others to act, model the way, and encourages the heart.”  Respectfully, I want your    self- declared team to openly challenge me just in one or all of the above leadership ground. If all ANA members approve your team's outline of thought as better one in open debate, I will be the first person to congratulate your so called brilliantine team.  Also, I will encourage many to be your paid disciples. So, now without murmuring under breath, having positive vetting, why don’t you set up a time and date  for a public debate  in forthcoming 29^th DC convention with every legal candidate to engage in such a debate where every member will have right to approve our  integrated road map. If you cannot advise for better process, you can not undermine your members' power with preposterous claim.  If not, it will be futile like Sisyphus to mix your stink of ego with whiff of perfume and so called prestige to discourage new comers to participate in democratic process.  As few of you claim your past with ANA, so do we claim our future with 110 percent vigor. 

  Nobody knows how high one jumps without first trying it on level playing field. So let's try to jump in front of the public without ignoring their duket sound of democracy. In this respect, I openly challenge your    self declared   team to defeat me in a real election process where every ANA's paid members' can exercise their unalienable right to vote. Therefore, as everybody, I do not have option to cachinnate at your legacy at this time. I won't lose my marbles with itchy feet to participate in election process. You might not like other peoples’ perspective but dare to listen them and make familiar to feel what most humans feel toward each other. Therefore, until and unless, I won't receive ANA majority of membership verification team's and election team's solid reason explaining the ground why I was deprived of serving my community by taking part in democratic process, nobody deserves such power to deny my candidacy except a federal court. We need to follow the due process to deny anything in legal provision in America, the country founded with Jeffersonian   vision of “life, liberty and pursuit of social happiness.”

The very competition will set up a tangible better course of action for ANA in the days to come.

यतिवेला अमेरिकामा सवैभन्दा जेठो संस्थाको रूपमा रहेको संस्था एशोसियसन अफ नेपलिज इन अमेरिकाज (एएनए) हरेक दुर्इ बर्षमा हुने पदाधिकारी चयनको लागि निर्वाचन र वासिङटन डिसीमा हुन गइरहेको २९ सम्मेलनको लागि व्यस्त छ । डेनवर, कोलोराडोमा हुने भनेर घोषणा गरिएको सम्मेलन आन्तरिक विवादको कारणले डिसीमा गर्न लागिएको बुझिएको छ । व्यस्तताकै कारणले हुनसक्छ बोस्टन सम्मेलनको घाटा प्रकरण एकाएक सेलाएर गएको छ । बोष्टन सम्मेलनको घाटा सम्बन्धमा एएनएले तत्कालिन लेखा परिक्षक हरि शर्माको नेतृत्वमा बोस्टन सम्मेलन आर्थिक अनुसन्धान समिती (Boston Convention Financial Investigation Committee BCFIC) र छेवाङ शेर्पा लामाको नेतृत्वमा स्वतन्त्र कार्य दल (Independent Task Force -ITF आइटीएफ) गरी दुर्इवटा आयोग बनायो । दुवै आयोगले प्रतिवेदन पनि उहिल्यै सार्वजनिक गरिसकेको छ । तर दुवै आयोग सत्य तथ्य बाहिर ल्याउन त के समस्या समाधान गर्न पनि असमर्थ रहेको मेरो बुझाइ छ । अझ शेर्पा नेतृत्वको कार्य दलले त ग्रीन सिग्नलको आधारमा कसैलार्इ चोख्याउने र कसैलार्इ दोषी ठहरयाउँदै पाइसकेको सम्मेलनको हिसाव किताव नपाएको भन्दै प्रतिवेदन सार्वजनिक गर्यो । स्थलगत अध्ययन र अनुसन्धान विना हचुवाको भरमा सार्वजनिक गरिएको त्यस्तो प्रतिवेदनको अमेरिकास्थित आम नेपाली जनसमुदायले खासै चासो नराखेको मेरो ठहर छ । तसर्थ एएनएको  २८ औं बोस्टन सम्मेलनका लागि म लगायत बोष्टन जिविएनसीका र अन्य साथीहरुको  लामो तयारी र सम्मेलनको बेलामा करिब ७ दिन भन्दा बढि लगातार खटाइले गर्दा सम्मेलनको बारेमा हामीलाई जति  यथार्थ जानकारी अरुलार्इ हुन नसक्ने दावी गर्दै सम्‍मेलनको वास्तविकता र दुवै आयोगको प्रतिवेदनलार्इ केलाउने जमर्को गरेको छु

एएनए को २८ औं बार्षिक सम्मेलन बोस्टनमा गर्न एएनए र ग्रेटर बोस्टन नेपाली कम्युनिटी (जिबिएनसी) को बीचमा एउटा संझौता भएको थियो । उक्त संझौता सन् २००९ र २०१० को विभिन्न मितिमा एएनएका तर्फबाट तत्कालिन उपाध्यक्ष तथा सम्मेलन अध्यक्ष मेदिनी अधिकारीले हस्ताक्षर गरेका थिए भने जिबिएनसीको तर्फबाट कन्‍भेनर  सुन्‍दर गुरूङ,  को-कन्‍भेनर उत्‍सब गुरुङ  र  को-कन्‍भेनर जाङ्बु शेर्पा ले हस्ताक्षर गरेक थिएं । सम्मेलनपूर्व सम्म सवै कुरा ठिकै थियो तर सम्‍मेलनमा ठूलो घाटा भयो भन्ने समाचारले एएनएमा महा भुकम्पै गयो जसले गर्दा एएनएका तत्कालिन उपाध्यक्ष तथा सम्मेलन अध्यक्ष मेदिनी अधिकारीले राजीनामा समेत गर्नुपर्यो ।
स्मरणरहोस् सम्मेलन संचालनार्थ व्यवस्थापन, दुवै संस्थाले गर्ने प्रारम्भिक लगानी, नाफा वा घाटाको बाँडफाँड, उत्पन्न विवादको समाधान, हिसाव किताव राख्ने तरिका, खाता संचालन, र लेखा परिक्षण लगायतका सम्पूर्ण बुँदाहरू समेटिएको छ उक्त हस्ताक्षरित संझौतामा । तर सम्मेलनभन्दा एक महिना पहिले सन् २०१० मे २१ मा एएनएका तत्कालिन अडिटर जनरल हरि शर्माले जिबिएनसीलार्इ आम्दानी, नगद व्यवस्थापन, र जिम्मेवारी तथा भरताल सम्बन्धि विभिन्न नीतिहरू सहितको एउटा प्रस्ताव पठाएको थियो जसलार्इ अंग्रेजीमा ANA Cash Management and Revenue Recognition Policy, Responsibility and Compliance Requirement (CMRRPRCR) भनिएको छ र उनीहरूले यसलार्इ आफ्नो अनुकूलको भाषामा Memorandum of Understanding (MOU) पनि भनेका छन् इमेल मार्फत । त्यो वास्तवमा MOU नभएर सम्मेलनमा स्थानिय आयोजकको एकल लगानीमा स्थानीयलार्इ जोताएर नाफा भए अधिकतम हिस्सा (70%) खाने र घाटा भए नव्यहोर्ने शर्त सहितको एउटा अवसरवादी प्रस्ताव मात्र थियो । अबसरबादी सोचाइमा तयार पारिएको उक्त प्रस्तावलार्इ स्थानिय आयोजक जिविएनसी पक्षले त्यतिवेलै अस्वीकृत गरेको थियो र त्यसमा हस्ताक्षर पनि गरेको छैन ।  हेर्नुस Boston Convention Financial Investigation Committee (BCFIC) को प्रतिवेदन जहाँ हस्ताक्षरै नभएको त्यही प्रस्तावको कागजको खोस्टो राखिएको छ । त्यसकारण पहिला भएको संझौता वमोजिम नाफा वा घाटा भएको खण्डमा एएनएले ७० प्रतिशत व्यहोर्ने शर्त बमोजिम नै काम भएको हो । पछिल्लोपटक एएनएले संझौता बमोजिम घाटा नव्यहोर्ने बहानाबाजी गर्दै एनआरएन निर्वाचनमा समेत विवादित व्यक्ति छेवाङ शेर्पा लामालार्इ स्वतन्त्र कार्य दल (Independent Task Force) गठन गरी बोस्टन सम्मेलनको घाटा सम्बन्धी समस्या समाधान गर्ने जिम्मेवारी सुम्प्यो र त्यसले जसले खटाएको हो त्यसैको स्वार्थ अनुरूपको प्रतिवेदन सार्वजनिक गरिसकेको छ ।

स्वतन्त्र कार्य दल (ITF) को प्रतिबेदन
बोस्टन सम्मेलनको घाटा प्रकरण लगायत एएनएको दैनिक क्रियाकलाप हेर्ने गरी गत फेब्रुअरी ६ तारेख बसेको एएनएको कार्यसमितीको वैठकले छेवाङ शेर्पा लामाको अध्यक्षतामा "स्वतन्त्र कार्य दल" जसलार्इ Independent Task Force (ITF आइटीएफ) भनि नामाकरण गरिएको छ, को स्थापना गरयो र सो दलमा छेवाङ वाहेक को कति सदस्यहरू छन् भन्ने पनि खुलाइएको छैन । सो दलले मार्च १ तारेख पाइसकेको रिपोर्ट अहिलेसम्म नपाएको भन्दै
सम्मेलन गर्न एएनए र जिबिएनसीको बीचमा भएको संझौताको अपब्याख्या गर्दै र माथी उल्लेखित अस्वीकृत अवसरवादी प्रस्तावको केही बुँदाहरूको आधारमा बोस्टन सम्मेलनको परिणाम प्रति एएनएको दायित्व नभएको कुतर्क गर्दै अन्तिम प्रतिवेदन रूपमा एउटा प्रतिवेदन गत मार्चको तेस्रो सातातिर सावर्जनिक गरयो । प्रतिवेदनमा GAAP र CMRRPRCR बमोजिम बोस्टन सम्मेलनको पूर्ण आर्थिक विवरण प्राप्त नभएकोले एएनएले आर्थिक दायित्व व्यहोर्न नपर्ने भनिएको छ । प्रतिवेदनको बुँदा नं. ४ मा सम्मेलनमा खटिने तथा सेवा पुरयाउने सरोकारवालाहरू (क्रेडिटरर्स/भेन्डर्स) लार्इ सेवा पुरयाएवापतको रकम भुक्तानी लिन सम्मेलन अध्यक्ष तथा एएनएको तत्कालिन उपाध्यक्ष मेदिनी अधिकारी (जो राजीनामा गरिसक्नु भएको छ) लार्इ  र मलाइ सम्पर्क गर्न भनिएको छ । साथै सपोर्टिङ कागजात सहीतको पूर्ण प्रतिवेदन पेश गर्न भनेको छ ।
पछिल्लो पटक सम्मेलनको हिसाव किताव सम्बन्धि आर्थिक विवरणको पूर्ण प्रतिवेदन एक महिना पहिल्यै एएनएले तोकेको लेखा परिक्षक (Auditor) एक क्षेत्रीलाइ पठाइ सकिएको छ र सो विवरणको प्याकेट एक क्षेत्रीले पाइसक्नु भएको छ भन्ने व्यहोरा गत मार्च ६ तारेख टेलीकन्फरेन्स मार्फत गरिएको एएनएको कार्यसमितीको वैठकमा समेत जानकारी भइसकेको छ र र्इमेल मार्फत प्रसारित निर्णय (Minutes) मा समेत उल्लेखित छ । उक्त आर्थिक प्रतिवेदनमा वासलात (Balance Sheet), आम्दानी र खर्च विवरण (Income Statement) र सँगै सपोर्टिङ वा तथ्यांकहरूलार्इ पुष्टि गर्ने कागजात (Verifiable Documents) को रूपमा बिल तथा भर्पाइ, बैंक स्टेटमेन्टस, पेपालको स्टेटमेन्ट, र भुक्तानी गरिएका चेकका प्रतिलिपिहरू संलग्न गरिएको थियो । एएनएको लेखापरिक्षकले  पाइसकेको विवरण स्वतन्त्र कार्य दलको अध्यक्ष छेवाङकहाँ पुग्दैन भने त्यो मेरो समस्या होइन तर पाउँदै पाएन भनेर झुटो बक्तब्य जारी गर्दै जनमानसमा भ्रम सृजना गर्न खोज्नु अत्यन्तै निन्दनीय कार्य हो जसको म घोर बिरोध र भर्सना गर्दछु । प्रतिवेदनले समस्या समाधान होइन झन बल्झाएको छ ।
स्वतन्त्र कार्य दल (ITF) वैधानिक छ ?
छेवाङ शेर्पा लामाको अध्यक्षतामा गठित Independent Task Force (ITF) जसलार्इ "स्वतन्त्र कार्य दल" पनि भनिन्छको बारेमा भन्नुपर्दा बोस्टन सम्मेलनको घाटा प्रकरण लगायत एएनएको दैनिक क्रियाकलाप हेर्न गत फेब्रुअरी ६ तारेख कोरमै नपुगी बसेको एएनएको कार्यसमितीको वैठक मार्फत यसको गठन भएको हो । कोरमै नपुगी बसेको अवैधानिक वैठकको निर्णयको कार्यसमितीका अधिकांश साथीहरूले त्यतिवेलै बिरोध गरेका थिए जब अध्यक्ष सिमोन ढुंगानाले जवर्जस्ती निर्णयलार्इ कार्यान्वयन गर्न तम्से । पछि निर्णयप्रति असहमत साथीहरूले एएनएको अर्कै तदर्थ समितीको समेत गठन गरेका थिए । ती दुर्इ समुहबीच अहिलेसम्म को बैधानिक भन्नेमा मतभेद कायमै छ भलै नयाँ हुन गइरहेको निर्वाचनले त्यसलार्इ ओझेलमा पारेको होस्  । यसरी अवैधानिक रूपमा गठित कार्य दलले सार्वजनिक गरेको प्रतिवेदनको वैधानिकता के हो? सबैले बुझनू जरुरी छ । करार वा संझौताको सामान्य सिद्धान्त अनुसार पनि संझौता कार्यान्वयन वा केही मतभेद वा विवाद भए दुवै पक्षलार्इ मान्य हुने मध्यस्तकर्ताको नियुक्ती गर्ने हो । तर यहाँ आफू र आफ्नो संस्थालार्इ आर्थिक घाटाको दायित्वबाट पन्छाउन संझौताको दोस्रो पक्ष जिबिएनसीलार्इ पूर्ण रूपमा उपेक्षा गरिएको छ । दुवै संस्था मिलेर गरेको कार्यक्रमबाट उत्पन्न परिणामप्रति दुवै संस्था जिम्मेवार हुन्छ र संझौता कार्यान्वयन तर्फ दुवै संस्था इमान्दार र प्रतिवद्ध हुनुपर्दछ तवमात्र समाजले विश्वास गर्छ । बोस्टन सम्मेलनको घाटा सम्बन्धमा एएनए अध्यक्ष सिमोन ढुंगानाले सार्वजनिक रूपमै नैतिक जिम्मेवारी लिइ सक्नु भएको (हेर्नुस DC मा  गरिएको भेलाको भिडियोमा सिमोन ढुंगानाको भाषण) सन्दर्भमा छेवाङको प्रतिवेदनले अमेरिका स्थित आम नेपाली समुदायबीच भ्रम सृजना गर्न खोजेको देखिन्छ । साथै पदीय प्रलोभनमा कसैलार्इ चोख्याउने र कसैलार्इ दोषी ठहरयाउने नियतले अवैधानिक कार्यदलले तयार पारी सार्वजनिक गरिएको उक्त प्रतिवेदनको वैधानिकता के ?
सम्मेलनमा मेरो भूमिका
सम्मेलन संचालनार्थ दुवै संस्थावीच भएको संझौतामा मेरो हस्ताक्षर तत्कालिन जिबिएनसीको अध्यक्षको हैसियतले संस्थागत प्रतिनिधीत्व हो, व्यक्तिगत कदापी होइन । गत दशैंपार्टीबाट म जिबिएनसीको अध्यक्ष पदमा पनि छुइन । यहाँहरू सवैलार्इ सर्वविदितै छ कि सम्मेलनमा मेरो भूमिका साँस्कृतिक कार्यक्रम संचालन गर्नु थियो र म त्यसको संयोजक थीए।
 सम्मेलन आयोजनाको नेतृत्वको जिम्मा समेत नलिएको, सम्‍मेलनको तीन दिनको आर्थिक कारोबारको  जीम्‍मेवारी पनि नलिएको र संस्थाको अध्यक्ष पनि नरहेको अवस्थामा संझौताको अपब्याख्या गर्दै घाटा प्रकरणमा व्यक्तिगत रूपमा मलार्इ मुछ्न जुन प्रपञ्च गरियो त्यसमा मेरो आपत्ती हो । कथित छेवाङ प्रतिवेदन महिना दिन पहिल्यै पुगिसकेको आर्थिक विवरणलार्इ कुनामा थन्क्याएर ग्याप र रेभ्न्यु रिकग्नीशन पोलिसीको रटान लगाउँदै ७० प्रतिशतको हिस्सेदार एएनएलार्इ दायित्वबाट पन्छाउन गरिएको नाटकीय प्रस्तुती सिवाय अरू केही होइन ।
छेवाङजी लगायत ग्यापको रटान लगाउनेहरुलाई म भन्न चाहन्छु भने अहिलेसम्म विगतका कुन चाँही एएनए सम्मेलनमा ग्याप र रेभ्न्यु रिकग्नीशन पोलिसी जस्ता लेखा सम्बन्धी सिद्धान्तहरूको लागू भएको थियो ? सम्मेलनको लागि स्थानिय साथीहरुबाट लिएको  सापटी र्फिता दिनु नियम संगत हुदैन भन्नेहरु ७० प्रतिशतका हिस्सेदारहरूले सम्मेलन संचालनार्थ आवश्यक रकमको व्यवस्था पहिल्यै गर्न किन सकेनन् ? स्थानिय साथीहरुको मेहनत मात्रै होइन, आर्थिक लगानीमा एएनए सम्मेलन गरि त्यसमा टाइ लगाएर भाषण गर्न आउने र के के न गरे भनेर जसलिन खोज्नेहरुले घाटा भएपछि बखेडा झिक्नु सुहाउँदैन । विगतका सम्मेलनहरु जस्तै यो सम्मेलन पनि विभिन्न नीति तथा नियम भन्दा व्यवहारिकतामा चलेको थियो र त्यो स्वभाविक पनि हो ।

घाटा किन भयो  ?

सम्मेलन संचालनार्थ कतिपय व्यवस्थापकीय र प्राविधीक कमजोरीहरू भएका थिए । होटलले सम्मेलनको लागि छुट्याइएका हलहरू समयमै उपलब्ध गराउन नसक्दा आम्दानीको मुख्य स्रोत मानिएका साँस्कृतिक कार्यक्रमहरू पछि सारिए र दोस्रो र तेस्रो दिनको डिजे नै स्थगित गर्नुपरयो । पहिलो दिनको डिजेमा करीब पन्ध्र हजार डलर  आम्दानी भएको थियो र त्यसको अनुपातमा दुर्इ दिनमा हुन सक्ने आम्दानी करीब तीस हजार डलर गुम्यो । सम्मेलन केन्द्र र कार्यक्रम स्थलहरू समदुरीमा नहुँदा फेशन शो लगायत खेलकुद प्रतियोगिताहरूमा दर्शकहरूको उचित सहभागीता हुन सकेन । होटल संझौतामा उचित ध्यान नपुरयाउँदा अनावश्यक खर्चहरूसमेत व्यहोर्नुपर्यो ।

 होटलले लगाएको ८०० क्षमताको शर्तले गर्दा  दोहोरी, कोसेली, र ग्राण्ड नेपाल नाइट लगायतका आम्दानीको मुख्य स्रोत मानिएका साँस्कृतिक कार्यक्रमहरूमा अग्रिम रूपमा टिकट खरिद गरेका दर्शकहरू कार्यक्रम हलभित्र जान पाएनन् । जुलाइ ४ मा राखिएको सम्मेलनको सवैभन्दा ठुलो कार्यक्रममा, अमेरिकाको स्वतन्त्रता दिवसको उपलक्ष्यमा गरिने फायर वक्सको कारण अपेक्षाकृत सहभागिता हुन सकेन । यस्ता विविध कारणहरूले गर्दा सम्मेलन ऐतिहासीक रूपमा सफल हुँदा हुँदै पनि अनपेक्षित घाटा हुन गयो तर सीमित व्यक्तिहरूले बाहिर प्रचार गरेजस्तो आर्थिक घोटाला र अनियमितता भएको जस्तो मलाइ लाग्दैन ।
अन्त्यमा समस्या बल्झाउनुभन्दा हिसाव कितावको उचित छानवीन गर्दै समस्या भए दुवै पक्षबाट एक एक जना लेखा परिक्षकको नियुक्ति गरेर आर्थिक प्रतिवेदनलार्इ अन्तिम रूप दिने साथै संझौता कार्यान्वयनमा दुवै पक्ष इमान्दार र प्रतिवद्ध हुनु नै अहिलेको आवश्यकता हो । यसैमा दुवै संस्थाको भलार्इ छ ।

माथिको यो लेख लेख्ने यिनै कोसाध्यक्ष्य हुन बोस्टन सम्मेलन का जसले कलाकार र भेन्डर हरुलाई पैसा नै नभएको खाताको चेक काटेर बेकुफ बनाउने काम गरे र सारा चेक बाउन्स भए अमेरिकामा पनि ठगी गर्ने यि ठग लाई अभिनन्दन गर्न बाँकी छ ! हेर्नुस् ठगी को प्रमाण !    

पैसा नभएका चेक काटेर कलाकारलाई चुना लगाउनु, आज सम्म भुक्तानी नहुनु लाई ए एन ए को नेत्रित्वको नालायकी पन र भ्रस्टाचार नभनेर के भन्ने ? कलाकारहरुको यो प्रश्नको उत्तर छ ए एन ए का नेता हौँ भन्ने हरुसँग ??

बोस्टन कन्भेन्सनदेखि बिबादास्पद रहँदै आएको र आर्थिक अनियमितताको छानबीन पछी गहन रुपमा पक्ष बिपक्षमा विभाजित एएनए अस्ति जून १४, २०११ देखि बिधिबत रुपमा बिबाद र विभाजित मानसिकताबाट थोरै भएपनि मुक्त भएको समाचार बाहिर आएको छ । निस्चय नै पनि त्यो सुखद समाचार हो ।

एएनए निर्बाचन आयोगका प्रमुख राजा उपाध्यायले सन् २०११-२०१३ को कार्यकालका लागि एएनएमा उम्मेद्वारी मनोनयन दर्ता गरेका सदस्यहरु मध्ये प्रतिस्पर्धी उम्मेदवारहरुको बैधानिकताका आधारमा बास्तबिक प्रक्रिया पछी अध्यक्ष, उपाध्यक्ष, महासचिब, कोसाध्यक्ष र सुचना निर्देशक निर्बिरोध निर्बाचित भएको भएको खबर सार्बजनिक गरेका छन । निर्बाचनको प्रकाशित नतिजा अनुसार अध्यक्षमा प्रल्हाद केसी, उपाध्यक्षमा रोजर अधिकारि, महासचिब पदमा राधा बस्न्यात, कोषाधक्ष पदमा डा. गम्भीरमान श्रेष्ठ र सूचना निर्देशक पदमा तुलसी जोशी निर्बाचित हुनु भएको छ । प्रमुख निर्बाचन आयुक्त उपाध्यायका अनुसार निर्बाचित एएनए बोर्ड अफिसरहरुको बिरुद्दमा परेका अन्य उम्मेदवारहरुको योग्यता नपुगेका कारण उनीहरुको उम्मेद्वारी स्वतः खारेज भएको थियो । प्रमुख निर्बाचन आयुक्त उपाध्यायले निर्बाचनको प्रक्रिया टुंगेको घोषणा गरि सकेपछी उनको नेतृत्वमा कार्यरत केहिले उपाध्यायको निर्णयको बिरुद्दमा यदाकदा आबाज निकालेपनि त्यसको केहि अर्थ नरहने बताईएको छ ।

महिनौदेखिको लम्बेतान लफडा अब बाँकी रहेन र त्यसलाई तन्काई रहनु पनि परेन । यो सबै पक्षको जीत जीतको अबस्था हो, त्यहा कसैले हारेको अनुभव गर्नु पर्दैन । एएनए एउटा सामाजिक संस्था हो र त्यो भित्र नेपालको अहिलेको दुर्गन्धित राजनीति र त्यसको प्रभाव हुल्नु पनि पर्दैन । समाज भए पछी संस्था हुने हुँदा आपसी छलफल र सामान्य रस्साकस्सी चल्नु स्वाभाविक हो, त्यो प्रजातान्त्रिक गतिबिधि नै हो । २८ बर्षदेखिका गतिबिधिहरु नियाल्ने हो भने पनि यस्ता रस्साकस्सिहरु निरन्तर चलिआएकै हुन्, तर २८ औं कन्भेन्सन पछी एएनए गतिबिधि परिपक्क ढंगबाट संचालित नभएका कारण संस्थाभित्र बिबाद र टक्कर देखापरेको हो, तथापी त्यो कुनै मोडमा साम्य हुनु नै थियो र अहिले त्यो अवसर जुटेको छ ।

एएनएका पूर्ब अध्यक्षहरुलाई छोडौं, व्यक्तिगत रुपमा बर्तमान अध्यक्ष सिमोन ढुंगाना पनि खराब मान्छे होइनन, न त् छेवांग शेर्पा नै पनि हुन् । २९ औं कन्भेन्सनका बिबिध पक्षहरुको मुल्यांकन गर्ने हो भने प्रसस्त चाप र तनावको मुकावला सिमोन ढुंगानाले बेहोर्दै आईरहेका छन्, यो उनको सामाजिक काममा फसेको अवसर र चुनौती दुवै हो । उनकै बोर्डले सिर्जना गरेको इन्डीपेनडेन्ट टास्क फोर्स, जसका अध्यक्ष छेवांग शेर्पा लामा छन, उनीमाथि पनि तनाव कम छैन भलै उनकालागि निर्देशित बोर्डका कामहरु धमाधम फत्ते हुँदै गईरहेका छन र उनको टाउको दुखाई कम हुँदै गएको अनुभव गरिदैंछ । बोर्डले जसरि टास्क फोर्सको गठन गरेको थियो सोहि प्रक्रियाले चुनाव आयोग र मेम्बर भेरीफिकेसन कमिटि बनेको थियो । सन् १९८० देखि नै एएनएको दुइ बर्षे कार्यकालको अन्त्यमा गरिने चुनावको सफलतापूर्बक सम्पन्न गर्नमा गहन भूमिका देखिंदै आएका उपाध्यायले २९ औं कन्भेन्सन चुनाव कन्भेन्सन भनेर गरिएको प्रचारको अन्त्य गरिदिए अन्तिम चुनाव नतिजा प्रकाशन गरिदिएर, यो च्याप्टर अब क्लोज्ड भयो । उपाध्यायका सहकर्मी सुदीप श्रेष्ठ र अन्य केहीका नामबाट अब असहमतिका स्वरहरु उठ्नुको केहि तुक रहन्न र त्यो मामलालाई सडकमा ल्याउनुको केहि अर्थ रहन्न । एएनए बोर्डकै सृजनामा मेम्बर भेरिफिकेशन कमिटि बशन्त श्रेष्ठको अध्यक्षतामा बनेको थियो र बिना बिबाद समय रेखाभित्र सदस्यता लिएका सदस्यहरुको नामावली प्रकाशन गर्ने उनको दायित्व पनि पूरा भयो । यी सब हिसाबले एएनएका निर्बाचन सम्बन्धि कामहरु सकिए र नयाँ एक्जुक्युटिब बोर्ड सन् २०११-२०१३ को कार्याबधिका लागि तयार भएको छ । काम गर्नेको गल्ति हुन्छ नगर्नेको के हुन्छ भन्ने नेपाली उखान नै छ नी, सबै पक्षको कहिँ न कहिँ गल्ती कमजोरी भएकै हुन् । सम्पन्न हुन् गैरहेको कन्भेन्सनको दुई हप्ता बाँकी समय अब बिबाद र लफडामा अल्झनु भन्दा छिटो छिटो काम सक्नु र हर्ष उल्लासका साथ कन्भेन्सन सक्नु उत्तम उपाए हुनेछ । बोर्ड अध्यक्ष सिमोन ढुंगानाले यो सरल उपाए बुझेर नव निर्बाचित बोर्ड सदस्यहरुलाई औपचारिक रुपमा कन्भेसन हलमा स्वागत गर्ने गरि पत्राचार गर्ने हो भने उनका पूर्वज नबिन दत्तले उनलाई दुई बर्ष अघि बुझाएको एएनएको साँचोको सहि अर्थ निस्कन्छ र एएनएको परम्पराको सहि मूल्य पनि देखिन्छ, अर्को मूलभूत कुरो अब एएनएका नाममा निस्कने सबै किसिमका बिबाद र लफडाको जिम्मेबारी नयाँ आगमन भैरहेको बोर्डलाई सुम्पने गहन अवसर पनि हो यो । जूलाई १ देखि एएनएका लफडाहरुको काँध थाप्ने काम उनको होइन । जिम्मेवारी हस्तान्तरणको यो अन्तिम घडीसम्म सफलतापूर्बक काम गर्ने छेवांग शेर्पा लामा, राजा उपाध्याए, बशन्त श्रेष्ठ, कुन्जर शर्मा, हरि शर्मा, अनिल पाठक, सुदीप श्रेष्ठ, एक क्षेत्री जस्ता प्रत्यक्ष र अप्रत्यक्ष शुभ चिन्तकहरुको बिध्यमान र भाबी दुवै बोर्डका अफिसरहरुको संयुक्त भेलाले कन्भेन्सनकै अबसरमा हात मिलाउने र सम्मान गर्ने कार्यक्रम अगाडी ल्याउन जरुरि छ । कम्तिमा यति हुन् सक्यो भने दुई बर्ष भरिको तितो मिठो सबै निरुपण हुने थियो र एएनए एक ढिक्का हुने थियो ।

कन्भेन्सन आयोजक समुहले दुखले गरिरहेका कामहरुको सहि मुल्यांकन त्यो बेला देखिने थियो जूनबेला सबै पक्ष हात मिलाएर कन्भेन्सन हल प्रवेश गर्छन । यो गहन जिम्मेबारी काँध थाप्ने काम अन्तिम घडीमै भए पनि बोर्ड अध्यक्ष सिमोन ढुंगानाको हो । उनले निर्बाचित भाबि बोर्डका सदस्यहरुलाई कन्भेन्सनस्थलमै स्वागत गर्ने र आफुले जिम्मेवारी सुम्पेको घोषणा गर्ने हो भने उनिप्रति भै रहेको नकारात्मक टिका टिप्पणीको अन्त्य मात्र होइन, उनकै व्यक्तित्व पनि उच्च देखिने हो । बोर्ड अध्यक्षको जिम्मेवारी सुम्पिए पछिका दिनमा बिबादका भूमरीमा नफस्न उनले सोच्ने बेला पनि यहि हो । अनेकौ ताप चाप र तनाब एएनए बोर्ड भित्र रहंदा बेहोर्नु परे पनि व्यक्तिगत पारिबारिक जीबनमा फर्कदा ति चाप र तनाब पनि भाबि बोर्डलाई सुम्पनु उनको लागि लाभदायी कुरो हो ।

बोस्टन कन्भेन्सन फ़िनान्सिअल् इन्भेस्टिगेसन कमिटीले बुझाएको रिपोर्ट सार्बजनिक भए पछी अनेकौ चाप र तनाबमा ढुंगानाले रात दिन बिताए । तत्कालिन कन्भेनर र बोर्डका कोषाध्यक्षको नीद हराम भयो तर जिम्मेवारीबाट मुक्त भए पछी आरामसँग निदाए, यो कुरो उनीहरुका लागि स्वास्थ्यबर्धक भयो । तर उनीहरुप्रति न्याय भयन । आर्थिक आक्षेपको भार उनीहरु माथि रहेकै छ, सबै पक्ष मिलेर उक्त भार हटाउने र मेदनी अधिकारि र उत्सब गुरुंगलाई पनि सार्बजनीक रुपमा स्थापित गराउन जरूरी छ । एएनएको आर्थिक लफडाको अर्को पाटो एड हक कमिटि निर्माण पनि हो, जसका कारणले शम्भु ढुंगाना लगाएतका सदस्यहरुको मान मर्दन भएको छ, त्यो सब कन्भेसन अघि फिर्ता लिएर उनीहरुलाई पनि कन्भेन्सनको ढोका खुल्ला गर्नु बुद्दिमानी हुनेछ । बुद्दुको मालिक बन्नु भन्दा विद्वानको नोकर बन्नु कति ठुलो कुरा होला विचारणीय छ ।

५ हजारबन्दा बढीको सहभागिताले बोस्टन कन्भेन्सन सफल भएको भनियो तर त्यहि सम्मेलन आयोजक एएनएको सदस्यता समय मै लिने र आबस्यक फी बुझाएर आफ्नो नाम सदस्यमा दर्ता गर्न २ सय ४४ लाइफ मेम्बर मात्रले सक्नु राम्रो समाचार होइन तर बास्तबिक कुरोलाई तोडमरोड गर्न र निर्बाचनको मुखमा हाम्रो पनि सदस्यता छ भनेर बिना आधार दाबि गर्नु पनि असल नियत होइन । २ सय ४४ लाईफ मेम्बरहरु मात्र बैधानिक रहेको २ लाख नेपालीहरु रहेको अमेरिकी भूमिको यो संस्था एक्जुक्युटिब क्लब जस्तो भयो तर निर्बाचनको मुखमा सदस्य नभएकाले उक्त क्लबमा आफ्नो दाबीलाई त्याग्नै पर्छ । आखिर निर्बाचन चाहिँ बैधानिक सदस्यहरुबाट मात्र सम्पन्न हुने हो र यो बिश्वब्यापी मान्यता हो ।

आजको दिनसम्म एएनए भित्र जतिसुकै बिकृति र विसंगतिहरुको प्रवेश भएको भनिए पनि नेपालको जस्तो दुगन्धित राजनीतिको ''र'' समेतको छायाँ देखापरेको छैन, यो सुखद बिषय हो । यस बिशएलाई सबै पक्षले मनन गर्नु जरुरि छ । बिग्रेको केही छैन, सुधार गर्न सकिने सम्भावनाका श्रोतहरु मनग्य छन । तर सबैले सुधार्न जरूरी बिषय हो नियत, सामाजिक सेबा क्षेत्रमा काम गर्नेले तेरो र मेरो, म, मेरो र मलाई भन्ने अहम त्याग्न जरूरी छ ।

दुई बर्षे कार्यकाल पूरा गरेर सिमोन ढुंगाना जाँदैछन, उनको बहिर्गमनलाई शान्तिपूर्ण र सम्मानजनक गर्न नयाँ बोर्डका निर्बाचित अध्यक्ष प्रल्हाद केसी र उनका सदस्यले कन्जुस्याई गर्नु हुँदैन, उनलाई अन्य पूर्ब अध्यक्षहरुलाई भन्दा बोर्ड हाकनमा बढी नै तनाव पर्यो, बिरोध मात्र होइन बैमन्स्यता निकै खप्न पर्यो यसलाई समेत मध्ये नजर राखी उनको कार्यकालको पूर्ब मुल्यांकन गर्न जरूरी छ । सिमोन ढुंगाना र बिध्यमान बोर्डका सदस्यहरुले नव आगन्तुक बोर्डलाई स्वागत र कम्तिमा अनेकौ लफडाबाजीबाट मुक्त हुने वा तिनको चुनौती सामना गर्ने अनुभव बाँडेर बिदा हुन् जरुरि छ ।

निर्बाचन पुरा नभएको वा नयाँ बोर्ड निर्बाचित नभएको हल्लाबाजिमा कम्तिमा बोर्ड अध्यक्ष सिमोन ढुंगाना स्पस्ट हुन् जरूरी छ, प्रमुख निर्बाचन आयुक्त राजा उपाध्यायले बोर्ड समक्ष बुझाएको निर्बाचित बोर्डको सूचिलाई स्वीकृत भएको सार्बजनिक गर्न जरुरि छ । सहि र वास्तविक निर्णय गर्न ढिलाई नगर्नु भनेको २९ औं कन्भेन्सन सफल पार्नु हो, जो उनको प्रमुख काम हो । अब पनि लफडाबाजीमा फसी रहने हो भने उनको शान्तिपूर्ण बहिर्गमनमा बाधा उत्पन्ने हुने मात्र होइन, यो मामला अब कानूनी कठघरामा तेर्सिने सम्भाबना पनि जल्दोबल्दो देखिन्छ । फेरी पनि तातो कराइमा मकै भुटिए झैँ भुटिई रहने उनको नियत बन्नु हुन्न, उनी त भुटिन तयार होलान तर पारिबारिक सुख र दाम्पत्य शान्तिका लागि पनि उनले बिचार पुर्याउन जरुरि छ ।

र अन्त्यमा, लफडाबाजीमा फसीरहने र अबैधानिक प्रक्रियालाई मलजल गरिरहने हो भने च्यानटिलि कन्भेन्सन अमेरिकामा बसेका अबैधानिक नेपालीहरुको आशंकीत हुलबाट सम्पन्न हुन् गैरहेको संकेत बाहिर जानेछ र ल-इन्फोर्समेन्ट अधिकारीहरु र अधागमन अधिकारीहरुको दबाब नेपाली कन्भेन्सन सहभागीहरुमाथि पर्न सक्ने कुरा औंल्याईदै छ । यदि त्यस्तो हालत कन्भेन्सन हलमा र होटल निवासमा भयो भने प्रमुख जिम्मेबारी पनि सिमोन ढुंगानाले नै लिनु पर्ने हुन्छ । दुखि नेपालीहरुको अमेरिकाबाट उठिबास लाउने थलो एएनए कन्भेसन हल बन्न गयो भने अनुमान गरौँ सिमोन ढुंगाना र उनका बिध्यमान बोर्ड सदस्यहरुको अमेरिका बसाई कति सहज होला ॽ
